10 OWI, fish fry guy loses appeal

A 78-year-old Wisconsin man doing prison time for drunk driving could not convince an appeals court to let him be re-sentenced.

John Przybyla of Adams County was given a seven-year prison term in 2015 for his 10th OWI.

Przybyla blamed his alcohol level on eating too much beer-battered fish at a fish fry, which led to this YouTube video.

Przybyla claimed the trial jury convicted him based on misleading instructions from the court but the appeals judges believed he would have been found guilty anyway, despite the mistaken instructions.
