Whitehall annexation knocked down by state Supreme Court
It’s back to circuit court in Trempealeau County for Whitehall’s attempt to annex land for a frac-sand mine.
The Wisconsin Supreme Court unanimously voted against the annexation of land from the Town of Lincoln on Wednesday, arguing there was not unanimous consent from all the property owners involved.
The court’s ruling comes exactly one year to the day after a Wisconsin appeals court upheld the annexation, over objections from the town that not all the property being annexed touched the Whitehall city limits.
The annexation of 1,200 acres was approved by the Whitehall city council four years ago.
Supreme Court justices chose not to rule on the town’s claim that the land to be annexed did not touch the Whitehall city limits.
