Tomah man who claimed he was fleeing from angry crowd loses appeal of OWI conviction
A Monroe County man trying to appeal an OWI conviction has been turned down by a state appeals court.
Dustin Yenter of Tomah was caught driving drunk in 2015, and argued that he was driving to get away from a group of more than a dozen people who attacked his car and threw rocks and sticks at the vehicle.
Yenter believed he was being followed, so he drove 16 miles before being pulled over by cops less than a mile from his house.
The appeals court rejected Yenter’s argument that the only way he could avoid another confrontation was to drive several miles at night while he was drunk.
