Appeals Court Shoots Down Hunter

You know the Miranda warning that police are supposed to give during an arrest…’you have the right to remain silent.’

Does that apply when a deer hunter is being questioned by a D-N-R warden?  Not in the case of a hunter from Crawford County.  A state appeals court has rejected a claim from Jody Bolstad of Ferryville that his 5th amendment rights were violated by a warden who questioned him last year.  Bolstad pled no contest to charges of not attaching an ear tag to a deer, and possessing a deer carcass out of season.  He wanted the convictions overturned because he wasn’t given his Miranda rights.  The appeals court says Bolstad wasn’t actually in custody, so he didn’t have to be read his rights.
