Winona Rental Case Is Constitutional According To Court of Appeals

The City of Winona has a rule that restricts the number of rental

properties to 30 percent of a city block. 4 plaintiffs say the city’s rule is unconstitutional and illegal because it prevents homeowners from renting their properties. The restriction on rental licenses was argued before a panel of three Minnesota Court of Appeals judges last Thursday. On Monday, those judges decided that Winona’s rule is constitutional. Attorney Anthony Sanders said not to expect the Court of Appeals ruling to be the end of the issue. He expects the case to go the Minnesota Supreme Court.
