Sparta man gets fifth OWI, threatens to urinate on police

Arrested for his fifth OWI was just the beginning of an early Sunday morning for a Sparta man.

Charles Vian Jr., was pulled over for not having his headlights on and swerving. His license plates were also ‘unauthorized.”

When Sparta officers approached, the 30-year-old Vian moved to the passenger seat and said the driver — and others — must have fled.

Asked what he drank, Vian told police it was “way more than two” alcoholic beverages. He was subsequently arrested for OWI.

Vian did refuse to submit to a legal blood draw following his arrest and a search warrant granted by a judge.

At the Sparta Mayo Hospital, however, Vian, swearing at staff and police, threatened to urinate on the arresting officer while trying to turn toward him.

He still refused a blood draw and had to be stabilized on a hospital bed after he tried to square up and kick his legs at officers, at which time the blood draw took place.

Vian was ultimately charged in Monroe County Circuit Court today with a slew of charges, including OWI, battery/threats to law enforcement, along with not having headlights on, swerving lane to lane, no insurance and false license plates.

Vian is free on a signature bond.
